TRUSTS OF LAND: Beneficial owner of house has no claim on purchaser who bought it from wife
A man who bought a house in his wife’s name, was later imprisoned for fraud, and emerged to find his wife had sold the house, has failed to establish his claim against the house’s new owner. The England and Wales High Court ruled that a purchaser of registered land from a sole trustee takes the land free of any beneficial interest under a trust of land unless the equitable owner is in actual occupation and has an overriding interest. The court told the husband that he should have registered a restriction against title to protect his interest (Haque v Raja, 2016 EWHC 1950 Ch)
