Judge defends wishes of mentally ill defendants
A judge has said “proper weight” must be given to the wishes and feelings of people who lack the mental capacity to make their own decisions about medical treatment. Mr Justice Jackson outlined his thoughts at the Court of Protection in a ruling on a case involving a mentally ill pensioner, as doctors wanted to remove his foot against the man’s wishes to save his life.
