Legal experts say Lucy Letby unlikely to get fresh appeal
Lucy Letby, who was convicted of murdering seven babies and six attempted murders, may not be entitled to a fresh appeal based on incorrect data used in her first trial, according to legal experts. The Crown Prosecution Service (CPS) has admitted a discrepancy in keycard doorswipe data for an intensive care ward at the Countess of Chester Hospital. The error was noted at Letby’s retrial, but it is unlikely to provide grounds for an appeal. Joseph Kotrie-Monson, a criminal defence lawyer, stated that the Criminal Cases Review Commission (CCRC) would have to be satisfied that the jury had been significantly misled. The CCRC has the power to return a case to the appeals court. However, Letby’s conviction has been reviewed by two juries and three appeal court judges.
